GA Workers Compensation Attorneys

Those who meet with our Atlanta workers comp attorneys at the Ibrahim Law Firm LLC are universally surprised to learn how common it is that those with on-the-job injuries do not get the coverage they expected from their workers compensation insurance without a fight.  And those who try to obtain these benefits quickly learn that it is not a fair fight.  Going up against an insurance company’s claims adjuster or lawyer is a battle rarely won unless you have the backing of an equally powerful and even more determined Georgia workers compensation attorney on your side.

Our Atlanta workers compensation attorneys know federal provisions and limitations

Georgia sets its own workers compensation laws, which are highly influenced by federal provisions.  Federal provisions and limitations include the following—

  • Set limits on awards for disability or death sustained while in the performance of the employee's duties
  • No benefits when the disability or death results from willful acts by the employee or caused by intoxication
  • Cover medical expenses resulting from the disability
  • May require employee job retraining
  • Disabled workers receive two-thirds of their normal monthly salary during disability
  • Permanently injured employees with dependents may qualify for more than two-thirds of their normal salary
  • Compensate survivors of employees who are killed on the job

When your rights or exclusions under federal laws are not clear to you, consult with a GA workers compensation attorney at our Atlanta law firm.

Georgia workers comp provisions and limitations

Georgia workers compensation laws, which you can review personally at the GA State Board of Workers Compensation, are complicated.  You can read their 75-page 2009 Rules, or review this list of key highlights assembled by our Atlanta law firm:

  • Coverage begins on the first day of your employment.
  • The law requires any business with three or more workers, including regular part-time workers, to have workers compensation insurance.
  • A GA worker selects a physician from a list of doctors maintained by the employer and posted at the job site.
  • You must report the injury to your employer (boss, foreman, or supervisor) immediately.  If you wait longer than 30 days, you may lose your benefits.
  • You are entitled to weekly income benefits if you are unable to work for more than seven days.
  • Your first weekly benefits check is mailed within 21 days after the first day you missed work.
  • You weekly benefits check will be two-thirds of your average weekly wage, but not more than $500 per week.
  • You are entitled to benefits for up to 400 weeks.
  • If your injury is catastrophic in nature you may be entitled to lifetime benefits.
  • If you can only acquire a lower-paying job when you return to work as a result of your injury, you receive a reduced benefit based upon your earnings for a maximum of 350 weeks from the date of injury and not exceeding $334 per week.
